Release from Liability and Assumption of Risk Form

This declaration and release (the “Release”) must be completed BEFORE the first day of camp.  Failure to do so will result in your child being denies access to camp.

Full compliance with all protocols will be compulsory for all Tennis Professionals, staff and campers.  Dunlace Junior Tennis (the “Camp”) reserves the right in its sole discretion to bar and/or remove a camper from attending Camp if full compliance is not maintained by either the camper, his/her parents and/or childminders.

This document is in addition to any and all existing Camp rules.

BY COMPLETING THIS RELEASE, YOU ARE GIVING UP LEGAL RIGHTS INCLUDING THE RIGHT TO SUE.

The Camp respectfully requires your cooperation to allow the Camp to operate and is relying on each parent’s assurances to the Camp and to each other in this document. Accordingly, any false statements could result in legal liability on the part of the parent.  Further, you agree to observe and have your children fully abide by all the rules and regulations prescribed by the Camp.

As you are aware, COVID-19 can be transmitted by asymptomatic people and accordingly the statements made by any parent contained in this Release cannot provide certainty that the virus will not be transmitted. The Camp is taking prudent steps to impose and enforce appropriate protocols to keep any camper safe, but there can be no assurances that the virus will not be contracted by them.  Attending the Camp could increase your (your child/ren, or anyone else that you are in close contact with) risk of contacting COVID-19, despite all preventative measures put in place.

This is a risk that each parent must assess for themselves, and if you choose to allow your children to come onsite, you are taking the risk that you, your children or anyone else that you/your children are in close contact with of either contracting the virus or transmitting it to others.  All parents of campers on their own behalf and on behalf of their children agree to release and waive all claims against the Camp and Dunlace Tennis Club, its executives, directors, officers, agents, contractors, representatives, and Tennis Professionals from any and all liability that they or any of them may have, for any personal injury, death, property damage or loss, sustained by a camper entering the facilities or anyone in your household in connection with or as a result of their entering the facilities due to exposure to COVID- 19.

 

 

By completing and submitting this Release you agree to the following:

I acknowledge the highly contagious nature of COVID-19 and I voluntarily assume the risk that I (my child/ren, or anyone else that I am in close contact with) could be exposed or infected by COVID-19 by mu children participating in activities at the Camp. Being exposed or infected by COVID-19 may particularly lead to injuries, diseases or other illnesses.
I declare that my child/ren am/are participating voluntarily in activities at the Camp.
I hereby declare that I or anyone in my household has not experienced any cold or flu-like symptoms in the last 14 days (including fever, cough, sore throat, respiratory illness or difficulty breathing). If I or anyone in my household experiences any cold or flu-like symptoms after submitting this Release, I will then not visit the Camp for a minimum period of 14 days after the cold or flu-like symptoms have completely gone away. This agreement will remain in effect until the executives of the Camp declares that the requirements in this declaration are no longer in effect.
I hereby declare that I or anyone in my household has not travelled to or had a lay-over in any province outside of Ontario or any country outside Canada in the past 14 days. If I or anyone in my household has travelled to any province outside of Ontario or country outside Canada after submitting this Release, I will then not visit the Club for a minimum period of 14 days after the date of return to Canada. This agreement will remain in effect until the executives of the Club declares that the requirements in this declaration are no longer in effect.
I have read and understand the DUNLACE JUNIOR TENNIS POLICIES AND PROCEDURES TO PREVENT THE SPREAD OF COVID-19 as communicated by the Camp and accept and waive any right to my child attending Camp should I or my child/ren not comply with these policies. The policies remain subject to update and change, from time to time, as the circumstances allow. I agree to follow all guidance from public health authorities, the City and Provincial Government and to the special safety regulations put in place by the Camp (collectively, the “Rules”) to ensure the reasonable safety of any camper entering the facilities.
Each parent will indemnify and hold the Camp, its executives, directors, officers, agents, contractors, representatives, and Tennis Professionals (collectively, the “Indemnitees”) harmless from any and all losses, liabilities, obligations, claims, contingencies, damages, reasonable costs and expenses, that Indemnitees may suffer or incur as a result of or relating to any untrue statement contained in this Release.
I confirm that I am 18 years of age, that I have completely read this Release and that I fully understand the provisions of this Release. I understand that I am responsible for compliance with the Rules, not only for myself but my family members including by child/ren. I am signing this Release on behalf of myself and my family members, including minors. I understand that by signing this Release I am giving up my legal rights including the right to sue if I or any family member or person with whom I am in close contact contracts COVID-19.
