Release from Liability and Assumption of Risk Form

This declaration and release (the “Release”) must be completed during registration process or during payment process for the seasonal membership. Failure to do so will result in denial of access to the Dunlace Park Tennis Club (the “Club”).

Full compliance with all protocols will be compulsory for all Tennis Professionals, staff and members. Members who do not adhere to the physical distancing requirements will be suspended from the Club until the COVID-19 restrictions are lifted and more permanently, at the sole discretion of the Club. During this time there will be no warning issued, these rules must be respected at all times and by all Tennis Professionals, staff and members no matter the circumstance or age.

The COVID-19 related rules and releases supersede all other rules and regulations of the Club.

BY COMPLETING THIS RELEASE, YOU ARE GIVING UP LEGAL RIGHTS INCLUDING THE RIGHT TO SUE.

The Club respectfully requires your cooperation to allow the Club to open tennis courts when it is appropriate and government regulations allow. The Club is permitting play in reliance on each member’s assurances to the Club and to each other in this document. Accordingly, any false statements could result in legal liability on the part of the member entering the Club facilities. Further, you agree to observe and fully abide by all the rules and regulations prescribed by the Club. Any failure in this regard may result in disciplinary actions.

As you are aware, COVID-19 can be transmitted by asymptomatic people and accordingly the statements made by any member in the Club facilities contained in this Release cannot provide certainty that the virus will not be transmitted. The Club is taking prudent steps to impose and enforce appropriate protocols to keep any member entering the Club facilities safe, but there can be no assurances that the virus will not be contracted by them. Attending the Club could increase your (your child/ren, or anyone else that you are in close contact with) risk of contacting COVID-19, despite all preventative measures put in place.

This is a risk that each member entering the Club facilities must assess for themselves, and if they choose to come onsite, they take the risk of either contracting the virus or transmitting it to others. Any member entering the Club agrees to release and waive all claims against the Club, its executives, directors, officers, agents, contractors, representatives, and Tennis Professionals from any and all liability that they or any of them may have, for any personal injury, death, property damage or loss, sustained by a member entering the Club facilities or anyone in that member’s household in connection with or as a result of their entering the Club due to exposure to COVID- 19.

 

By completing and submitting this Release you agree to the following:

I acknowledge the highly contagious nature of COVID-19 and I voluntarily assume the risk that I (my child/ren, or anyone else that I am in close contact with) could be exposed or infected by COVID-19 by participating in activities at the Club. Being exposed or infected by COVID-19 may particularly lead to injuries, diseases or other illnesses.
I declare that I or my child/ren am/are participating voluntarily in activities at the Club.
I hereby declare that I or anyone in my household has not experienced any cold or flu-like symptoms in the last 5 days (including fever, cough, sore throat, respiratory illness or difficulty breathing). If I or anyone in my household experiences any cold or flu-like symptoms after submitting this Release, I will then not visit the Club for a minimum period of:

  • 5 days for children <12y, and fully vaccinated individuals (current definition for "fully vaccinated" is 2 doses)

  • 10 days for immune compromised patients, hospitalized for their COVID symptoms, and those with <2 vaccine doses

    • This agreement will remain in effect until the executives of the Club declares that the requirements in this declaration are no longer in effect.
    I hereby declare that If I or anyone in my household has travelled to any province outside of Ontario or country outside Canada after submitting this Release, I would be following federal quarantine travel rules, as outlined by the Government of Canada including the requirements outlined for fully vaccinated and quarantine-exempt travelers.
    I have read and understand rules as communicated by the Club and accept and waive any right to having access privileges should I not comply with these policies. The policies remain subject to update and change, from time to time, as the circumstances allow. I agree to follow all guidance from public health authorities, the City and Provincial Government and to the special safety regulations put in place by the Club (collectively, the “Rules”) to ensure the reasonable safety of any member entering the Club facilities.
    Each member entering the Club facilities will indemnify and hold the Club, its executives, directors, officers, agents, contractors, representatives, and Tennis Professionals (collectively, the “Indemnitees”) harmless from any and all losses, liabilities, obligations, claims, contingencies, damages, reasonable costs and expenses, that Indemnitees may suffer or incur as a result of or relating to any untrue statement contained in this Release.
    I confirm that I am 18 years of age, that I have completely read this Release and that I fully understand the provisions of this Release. I understand that I am responsible for compliance with the Rules, not only for myself but my family members including by child/ren. I am signing this Release on behalf of myself and my family members, including minors. I understand that by signing this Release I am giving up my legal rights including the right to sue if I or any family member or person with whom I am in close contact contracts COVID-19.
